Terms of service
The agreement between you and Burly when you buy a challenge and use the site.

1. What Burly is
Burly provides paid trading evaluations ("challenges") and, to participants who pass and are verified, simulated funded accounts with performance rewards. Burly is not a broker, an exchange, an investment adviser or a fund. Nothing you do on Burly places an order on any market on your behalf.
All Burly accounts are simulated. Orders are filled by our engine against Bulk's live mainnet order book at real fees and real funding, and no trader funds are deposited or put at risk beyond the challenge fee. Payouts are performance rewards paid by Burly from its own funds. Burly may trade for its own account on Bulk, including by replicating traders' positions.
2. Who may use it
- You must be a natural person aged 18 or over. Legal entities are not accepted.
- You must not live in, or access the service from, a restricted jurisdiction. The list is on the Restricted jurisdictions page.
- One profile per person. You may not use another person's identity or wallet, or let anyone else trade your account.
3. Your account and wallet
You sign in by signing a message with a Solana wallet you control. You are responsible for that wallet. Burly never asks for a seed phrase or a private key. We may ask for an email address for notices, and after you pass an evaluation we verify your identity before a funded account is activated.
4. Fees and refunds
A challenge is bought for a one-time fee in USDC on Solana. There are no recurring charges. The price quoted at checkout is held for 30 minutes. Refunds are governed by the Refund policy, which is part of these terms.
By buying a challenge you ask for the service to start immediately. Where a statutory right to withdraw from a distance contract would otherwise apply, you acknowledge that you lose it once you place your first order; until then the Refund policy gives you 7 days.
5. The rules
Each account is evaluated under the ruleset in force when it was bought, identified on your account and on the Rules page. A later ruleset never applies to an existing account. The rules set the profit targets, the two loss limits, the checks before a pass or a payout, the leverage caps and the prohibited practices. Touching a loss limit closes the account automatically and permanently.
6. Funded accounts and payouts
After you pass the challenge you must complete identity verification within 30 days, otherwise the enrollment expires. A funded account is simulated. A payout may be requested every 14 days, the first one 14 days after your first funded trade, when the conditions in the Rules are met. We decide a payout within 2 business days and send it within 24 hours of approval, in USDC to your verified, self-custodied wallet.
A payout can be refused only on the grounds listed in the Rules: an unmet condition, an open conduct review, or an upheld conduct violation. A refusal for an unmet condition restores the swept profit to the account. Payouts are unsecured obligations of Burly and are not held in escrow.
7. Conduct, suspension and termination
The prohibited practices are listed in the Rules. A suspected violation is flagged automatically and reviewed by a person. Outcomes are a warning, removal of the profit from the affected trades, or termination without payout. You may appeal a conduct decision once, to a reviewer who did not take the original decision, and a breach within 7 days on the grounds in the Rules.
If Burly closes a funded account for a reason that is not a breach or a conduct violation, you are paid a final payout of all profit above the starting balance at your current split, and the fee if no payout was ever made.
8. Market data and availability
Prices come from Bulk's public market data. If a feed is stale or a market is not trading, new orders in that market are rejected and no breach is declared on a stale price. The service may be interrupted for maintenance or by events outside our control. An error in price or in the platform that affects your account is corrected through the appeal process.
9. Taxes
You are responsible for reporting and paying any tax due on payouts you receive. Burly does not give tax advice and may be required to report payments to tax authorities.
10. Liability
To the extent the law allows, Burly's liability to you in connection with a challenge is limited to the fee you paid for it, plus any payout that was approved and not paid. Nothing in these terms limits liability that cannot be limited by law, or removes rights you have as a consumer where you live.
